Appeal Processes

There are a number of processes for appealing decisions made by Golden Gate Regional Center regarding the rights, eligibility or services of persons served by the agency. The circumstances in which each process can or should be used are explained below.



Appeal Process

The Appeal Process can be used to appeal a decision made by GGRC regarding an individual's eligibility for Lanterman Act services or the provision of services to an individual by the agency's Lanterman Act services program. This process may include a voluntary informal meeting, mediation conducted by the Office of Administrative Hearings (OAH), or a fair hearing conducted by the OAH.

Consumer Rights Complaint Process

The Consumer Rights Complaint Process can be used by any individual or family who believes that GGRC or a GGRC service provider has violated or improperly withheld a right to which the individual or family is entitled under the law. In using this process, the complainant (individual or family) is asking the regional center or provider to change its procedures in order to prevent future (and/or stop current) rights violations.

Early Start Mediation Conference Requests

An Early Start Mediation Conference Request can be made to resolve an Early Start eligibility- or service-related disagreement between a family, GGRC and/or a local education agency. These requests are submitted to the state agency responsible for Early Start mediation, the Office of Administrative Hearings.

Early Start Due Process Hearing Requests

An Early Start Due Process Hearing Request can be made to resolve an Early Start eligibility- or service-related disagreement between a family, GGRC and/or a local education agency. Like requests for mediation (see above), these requests are submitted to the Office of Administrative Hearings.

Early Start State Complaint Process

The Early Start State Complaint Process can be used to report possible violations of laws or regulations governing California's Early Start program, including those pertaining to eligibility and services. In this process, a complaint may be filed against GGRC (or any regional center), DDS, the California Department of Education, a local education agency, or a regional center service provider.
